Introduction

Welcometo Dolly Boat Charters. By accessing or using our services and website, youagree to be bound by these Terms and Conditions. Please read them carefullybefore making any bookings or using our services. If you do not agree with anypart of these terms, you must not use our services or website.

Bookings and Payments

  • All bookings are subject to availability and confirmation by Dolly Boat Charters.
  • A deposit may be required at the time of booking. The remaining balance is dueprior to the commencement of your charter, as specified in your booking confirmation.
  • Accepted payment methods include credit card, bank transfer, or other methods as notified by Dolly Boat Charters.
  • All prices are in Australian dollars ($AUD) and exclude GST unless otherwises pecified.

Cancellations and Refunds

  • If you wish to cancel your booking, you must notify us in writing as soon as possible.
  • Cancellation fees may apply, depending on the notice period provided and as detailed in your booking confirmation.
  • No-showsor cancellations made within 7 Days of the scheduled charter may result in forfeiture of payment.
  • If Dolly Boat Charters must cancel a booking due to unforeseen circumstances, you will be offered a full refund or the option to reschedule.

Changes to Bookings

  • Requests to change a booking (such as date or time) are subject to availability and must be made in writing.
  • Dolly Boat Charters reserves the right to charge an administrative fee for changes to confirmed bookings.

Safety and Conduct

  • All guests must comply with the instructions of the captain and crew at all times for their own safety.
  • Dolly Boat Charters reserves the right to refuse service or terminate a charter without refund if guest behaviour is deemed unsafe, unlawful, or disruptive.
  • Consumption of alcohol is permitted in moderation, but illegal substances are strictly prohibited.
  • Life jackets and other safety equipment must be used as directed.
  • Damage, Misuse, and Negligence by Charterer
  • Charterers and their guests are responsible for any damage, loss, or excessive cleaning required resulting from misuse, negligence, or wilful actions during the charter period. Dolly Boat Charters reserves the right to recover costs for repairs, replacements, or cleaning from the charterer. This may include, but is not limited to, damage tothe vessel, fixtures, fittings, equipment, or personal property.
  • If damage or loss occurs due to misuse or negligence by the charterer or their guests, Dolly Boat Charters may withhold part or all of any security depositpaid, or invoice the charterer for the full amount of the repair or replacement costs. Failure to pay such costs may result in legal action.

Liability and Insurance

  • Dolly Boat Charters takes all reasonable care to provide a safe and enjoyable experience. However, participation in boating activities involves inherent risks.
  • To the fullest extent permitted by law, Dolly Boat Charters and its employees are not liable for any injury, loss, damage, or expenses incurred by guests duringthe charter, except where caused by our proven negligence.
  • Guests are advised to arrange their own travel insurance to cover unforeseen circumstances.

Weather and Force Majeure

  • The safety of our guests is our top priority. In the event of adverse weather orother conditions beyond our control, Dolly Boat Charters reserves the right to alter or cancel charters at short notice.
  • No liability is accepted for delays or cancellations due to events outside our reasonable control (force majeure), including weather, natural disasters, or government restrictions.

Privacy

Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

Intellectual Property

  • All content on the Dolly Boat Charters website, including text, images, and logos, is the property of Dolly Boat Charters or its licensors and is protected by copyright laws.
  • You may not reproduce, distribute, or use any content from our website without our prior written consent.

Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
